These Terms of Use (“Terms”) govern your access to and use of xxcode (“xxcode,” “we,” “us,” or “our”), including our websites, applications, and related services (collectively, the “Service”). By creating an account or using the Service, you agree to these Terms. If you do not agree, do not use the Service.

1. Not medical advice

The Service is designed for education and informational purposes for qualified healthcare professionals and researchers. It is not medical advice, a medical device, a diagnostic tool, or a substitute for your own professional training, clinical judgment, and direct evaluation of patients and sources.

You are solely responsible for all clinical decisions. Never rely on summaries, audio, or other outputs from the Service as a sole basis for diagnosing, treating, or managing any medical condition. Always consult primary literature, institutional protocols, applicable standards of care, and—where appropriate—specialist colleagues. Use of the Service does not create a physician–patient or clinician–patient relationship between you and xxcode or its personnel.

2. AI-generated content and accuracy

The Service uses artificial intelligence and large language models (“LLMs”) to aggregate, summarize, and present medical literature. AI outputs may be incomplete, biased, outdated, or erroneous. They may omit important nuance, misstate findings, or include content that appears plausible but is incorrect (“hallucinations”).

You assume all risks associated with reliance on AI-generated summaries, digests, transcripts, audio, or other materials. You must independently verify any information that could affect patient care or professional decisions—especially dosing, contraindications, trial outcomes, and safety data—against the original publications (for example, full-text articles and official PubMed records) and other authoritative sources.

3. Medical literature summaries; no full-text articles

The Service provides summaries, digests, audio narration, curated metadata, and links based on citations and indexing information concerning scientific and medical publications. We do not reproduce, host, or deliver the complete full text of copyrighted journal articles, book chapters, or similar works through the Service.

Full-length articles are typically owned by publishers and authors and protected by copyright. We do not have unrestricted rights to copy or distribute those works in full, and doing so without proper authorization could violate publisher terms and applicable law. Where you require the authoritative manuscript, you must obtain it directly from the publisher, PubMed, PubMed Central, your institution, Open Access venues, or other lawful channels you are entitled to use.

References to freely available literature (such as OA or PubMed Central) reflect public information and links only; accessing the underlying file remains subject to publisher policies, licensing, and your own eligibility. These Terms do not grant you any license to third-party copyrighted works beyond what xxcode itself is permitted to offer.

4. Limitation of liability

To the fullest extent permitted by applicable law, xxcode and its affiliates, officers, directors, employees, contractors, and licensors shall not be liable for any indirect, incidental, special, consequential, exemplary, or punitive damages, or for any loss of profits, revenues, data, goodwill, or other intangible losses, arising out of or related to your use of or inability to use the Service—including any alleged harm, adverse clinical outcome, or professional liability claim—even if we have been advised of the possibility of such damages.

To the fullest extent permitted by law, our aggregate liability for any claim arising from the Service shall not exceed the greater of (a) the amount you paid us for the Service in the twelve (12) months before the claim or (b) one hundred U.S. dollars (USD $100). Some jurisdictions do not allow certain limitations; in those jurisdictions, our liability is limited to the maximum extent permitted by law.

5. “As is”; warranties disclaimer

The Service is provided “as is” and “as available,” without warranties of any kind, whether express, implied, or statutory, including implied warranties of merchantability, fitness for a particular purpose, title, and non-infringement, and any warranties arising from course of dealing or usage of trade—all expressly disclaimed to the fullest extent permitted by law.

We do not warrant that the Service will be uninterrupted, error-free, secure, or free of harmful components; that AI outputs will be accurate, complete, current, or suitable for any purpose; or that any errors will be corrected. Your use of the Service is at your sole risk.

6. General

We may modify these Terms from time to time. Continued use of the Service after changes become effective constitutes acceptance of the revised Terms. If any provision is held invalid, the remainder remains in effect. These Terms are governed by the laws applicable to xxcode as determined by us, without regard to conflict-of-law principles, except where prohibited.
